Brian King Joseph, a former contestant on America’s Got Talent, has initiated a lawsuit against actor Will Smith and his management company, alleging harassment, undue pressure, and emotional distress.
Musician Brian King Joseph has filed legal action accusing Will Smith and his management firm Treyball Studios of sexual harassment, wrongful dismissal, and fostering a hostile working environment, according to court documents obtained by Variety.
Details of the Lawsuit: Who’s Involved?
The plaintiff, violinist Brian King Joseph, who previously appeared on America’s Got Talent, is suing both Will Smith and Treyball Studios. He claims that during their professional relationship, he was subjected to unwelcome sexual advances and significant pressure from Smith.
Beginning of Collaboration and 2025 Tour Engagement
According to the lawsuit, Joseph was hired by Smith in November 2024 to perform in San Diego. Subsequently, he was invited to join Smith’s spring 2025 concert tour titled Based on a True Story.
Joseph alleges that the harassment began during this tour, with Smith exhibiting what the plaintiff describes as “predatory behavior” and pursuing a “special connection” with him that Smith claimed was unique and not shared with others.
The Incident in Las Vegas
The pivotal event took place in March 2025 in Las Vegas. Joseph reported that after his hotel room key bag went missing and then was found, he discovered evidence of unauthorized entry into his room.
Inside, he found wet wipes, a prescription bottle for medication related to HIV complications issued under another name, and a note that read:
“Brian, I’ll be back by 5:30 at the latest, just us,” signed with a heart and the name “Stone F.”
Joseph interpreted this as a sexual threat and a serious invasion of his privacy.
Aftermath and Termination
Following the incident, Joseph notified hotel security, Smith’s team, and filed a police report. However, the lawsuit states that shortly after, Smith’s manager “shamed” him over the situation and informed him of his dismissal.
Joseph asserts that he was also made to feel the incident was either fabricated or overstated, adding to the pressure he experienced.
Claims and Requested Remedies
Joseph claims the ordeal has inflicted significant psychological damage, including post-traumatic stress disorder, alongside financial harm due to his job loss.
He is seeking compensation for sexual harassment, wrongful termination, and workplace-related pressure, with the amount of damages to be decided by a jury.
Will Smith’s Response
As of now, representatives for Will Smith and Treyball Studios have not issued any statements regarding the lawsuit.
